A Barcelona home rental requires a cash deposit (fianza) of one month’s rent, which the landlord must lodge with INCASÒL, the Generalitat’s housing institute, within two months of signing. As of November 2026, extra guarantees are capped at two months’ rent on standard leases, and agency fees cannot be charged to the tenant.

How much can a landlord ask for upfront?

Article 36 of the tenancy law (LAU) sets the deposit for housing at one month of rent, paid in cash or by transfer when the contract is signed. On top of that, the law allows an additional guarantee, such as a bank guarantee or a further cash amount, with limits. The current text of the tenancy law on the BOE also forbids asking for more than one month of rent in advance.

Item Limit as of November 2026
Legal deposit (fianza) 1 month of rent
Additional guarantee, leases up to 5 years (7 if the landlord is a company) Up to 2 months of rent
Additional guarantee, temporary leases Up to 1 month of rent
Rent paid in advance No more than 1 month
Agency and contract fees Paid by the landlord, not the tenant
Rent default insurance Cannot be imposed on the tenant

The one-month cap for temporary leases, the ban on forcing tenants to take out rent default insurance and the end-of-lease document described below were added by Real Decreto-ley 29/2026, in force since 8 October 2026. A decree-law must be confirmed by Congress, so check the BOE text if you sign a lease in the coming weeks.

Who pays the agency fee?

Since the 2023 housing law, property management and contract formalization costs cannot be passed to the tenant, directly or indirectly, under any name. That covers fees for preparing, signing, managing, changing or renewing the contract. Any other service the agency offers can only be charged if you asked for it in writing after being told it is optional and how much it costs. A fee labeled “file opening”, “reservation” or “management” that is really for arranging the lease falls under the ban.

Where does the deposit go?

In Catalonia the landlord does not keep the fianza. They must deposit it with INCASÒL within two months of the contract date. Registration in INCASÒL’s deposit register takes about 15 days after payment. The additional guarantee is not lodged there; it stays with the landlord under the contract terms.

To check that your deposit was lodged, use INCASÒL’s register lookup. It needs one of these codes, which the landlord gets when paying: the control number (NC) from the deposit form, the register number, or a payment reference. Ask the landlord for a copy. If you have none, INCASÒL offers a deposit status check, and either party to the contract can request an information certificate by email or post, usually answered within about a month.

How do you get the deposit back?

  1. Before you move in, photograph every room and list existing damage. Send the list to the landlord by email so it is dated.
  2. Give notice as your contract requires. Our guide to Spanish rental contracts explains notice periods.
  3. On the last day, walk through the flat with the landlord and sign an end-of-lease document stating its condition. Since October 2026 the law requires this document; if none is signed, or it lists no damage, the flat is presumed returned in good condition unless proven otherwise.
  4. Hand back all keys and get written confirmation of the date.
  5. The landlord recovers the deposit from INCASÒL and returns it to you, minus any justified deductions for unpaid rent, bills or damage beyond normal wear.
  6. If the balance is not repaid within one month of handing back the keys, it starts earning statutory interest under article 36 of the tenancy law.

What if the landlord keeps the deposit?

Send a written demand, by burofax (a certified letter service run by Correos) or another dated method, listing the amount, the key handover date and your bank details. Many disputes end at this stage. If they do not, consumer mediation through the Agència Catalana del Consum or Barcelona’s consumer office may help when the landlord is a company or agency. Recovering money from a private landlord is a civil claim; for small sums Spanish courts have a simplified procedure, and a lawyer or tenants’ advice service can tell you whether it fits your case.

Bottom line

Ask for the INCASÒL deposit code when you sign, not when you leave, because it is your proof that the money exists and where it is. Refuse any fee for arranging the lease, and pay everything by bank transfer so there is a record.

FAQ

Can the landlord use the deposit for the last month’s rent?

The deposit guarantees your obligations, so the landlord can deduct unpaid rent at the end. Skipping the last month without agreement in writing can lead to a dispute over damage deductions, so agree it in advance.

Does the deposit go up when the rent rises?

Not during the first five years (seven with a company landlord). At each later extension it can be adjusted to match the current rent.

Do these rules apply to room rentals?

Rooms rented as a person’s main home fall under the tenancy law. If you rent from the main tenant rather than the owner, check your agreement and the rent rules in our guide to the Barcelona rent cap.
