Seasonal and Room Rentals in Catalonia: The Rules Since 2026

Catalan Law 11/2025 closed the gap that let short and room lets escape the rent cap. Here is what counts as seasonal now and what tenants can check.

Since 1 January 2026, Catalonia treats any rental that meets a housing need as a permanent home, however short the contract. Under Law 11/2025, a seasonal lease needs a stated and documented reason such as work, study or medical treatment, and it follows the same deposit and rent rules as an ordinary lease, including the rent cap in Barcelona.

What changed on 1 January 2026?

The Catalan Parliament passed Llei 11/2025, de mesures en matèria d’habitatge i urbanisme (Law 11/2025 on housing and urban planning measures) on 29 December 2025. It was published in the Catalan official gazette (DOGC) on 31 December 2025 and took effect the next day. The Spanish translation is in the state gazette (BOE).

The law adds two articles to Catalonia’s Right to Housing Act (Law 18/2007): article 66 bis on temporary leases and article 66 ter on room rentals. Until then, temporary and room contracts had no specific definition in Catalan housing law. The new articles define them so they cannot be used to get around the rules on rents and deposits.

Which short contracts still count as seasonal?

The law starts from one principle: a lease that meets someone’s need for a home is a permanent housing lease, whatever its length. Two kinds of short contract remain possible.

  • Temporary leases for a documented reason. The reasons named in the law are work or professional reasons, studies, medical care or treatment, waiting for a new home to be handed over, waiting to return to your usual home, and similar uses that still meet a housing need.
  • Holiday or leisure lets. A flat rented purely for recreation, holidays or leisure falls under the rules for non-housing leases. The contract must say so, include the supporting documents and state where the tenant permanently lives.

In both cases the contract must state its purpose, and the supporting documents must be lodged with the deposit at the official deposit register. If the register shows no documented purpose other than housing, the law presumes the lease is a permanent home.

Does the rent cap apply to seasonal rentals?

Yes, for the first group. Temporary leases for work, study, health and similar reasons now follow the ordinary housing rules on:

  • the deposit (fiança) and any extra guarantees
  • how the rent is set and updated, which in a stressed zone means the rent cap
  • rent increases for improvement works
  • which general costs and individual services the tenant can be asked to pay

The same rules apply to any lease that sets a duration but does not state a temporary purpose. Barcelona is a declared stressed rental market, so the starting rent is limited as explained in our guide to the rent cap in Barcelona. Holiday lets, by contrast, stay under the rules for non-housing leases.

What are the rules for renting a room?

A room rental is defined as a contract giving the tenant exclusive use of one room plus the right to use the shared spaces of the flat, in exchange for rent. The law sets three rules:

  1. The number of people and the space per person must respect the housing standards and the maximum occupancy shown on the flat’s cèdula d’habitabilitat (habitability certificate).
  2. Splitting a flat into rooms, or into several contracts, does not change the fact that it is a housing lease, so housing rules still apply.
  3. In a stressed zone such as Barcelona, the rents of all room contracts running at the same time in one flat cannot add up to more than the maximum rent for the whole flat.

To check the third rule, you need to know the capped rent for the full flat and what the other rooms pay. Adverts and contracts in stressed zones must state the maximum permitted price, so ask for it in writing.

What happens when a seasonal contract is extended?

This is where many tenants gain rights. The law sets out what happens at the end of a temporary lease:

Situation Result under article 66 bis
The lease is extended and the tenant has not documented the temporary reason and a home elsewhere It becomes a permanent housing lease, with the legal minimum duration and extensions counted from the start of the first contract
A new contract is signed with the same tenant for the same flat The new contract is a permanent housing lease, unless the landlord proves the temporary need still exists
The temporary reason is documented and continues The lease can continue as temporary, still under the deposit and rent rules above

A permanent housing lease gives the tenant the minimum durations of the Spanish tenancy law, explained in our guide to Spanish rental contracts.

What can tenants do if the rules are not followed?

Start by asking the landlord or agency, in writing, for the contract purpose, the documents lodged with the deposit and the maximum permitted rent. Check that your deposit was registered; our guide to the rental deposit in Barcelona shows how.

The law also creates a Commission for the Supervision of Housing Lease Contracts within the Generalitat, which oversees rental platforms and advertisements and coordinates compliance, and it gives housing inspectors the status of public authority agents. For a disputed contract, the Generalitat’s housing information services, the city’s consumer office and a tenants’ lawyer are the usual first contacts. For anything beyond a simple correction, get individual legal advice before you stop paying or sign a new contract.

Bottom line

If you rent for work or study, make sure the contract names that reason and that the supporting document, such as a work contract or enrollment letter, is lodged with the deposit, because that protects both sides. If you have renewed a “seasonal” contract for an ordinary home without any documented reason, you may already have the rights of a permanent tenant.

FAQ

Is an 11-month contract still legal in Barcelona?

Yes, if it is a genuine temporary lease with a stated and documented reason, such as a work posting or a study course. Without that, the law treats it as a permanent housing lease.

Do I pay a deposit on a room or seasonal rental?

Yes. Temporary leases for housing reasons follow the ordinary deposit rules, and the supporting documents are lodged together with the deposit.

Does the law cover tourist flats?

No. Short stays in licensed tourist flats are a separate regime. Our guide to Barcelona tourist flat licences covers those rules.

Can a landlord charge more for rooms than for the whole flat?

Not in a stressed zone. The rents of all room contracts in the same flat, running at the same time, cannot add up to more than the maximum rent for the flat as a single lease.
